1. Services

Modern Yardz is a licensed California design-build firm (Contractor License #1082881) providing luxury landscape design and build services throughout San Diego County. Our offerings include custom pool and spa design, outdoor kitchens, premium paver installation, pergolas and shade structures, fire features, artificial turf, landscape lighting, retaining walls, and full outdoor living renovations. 2. Acceptance of Terms

By using the Site, submitting a form, requesting a consultation, or otherwise engaging Modern Yardz, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, you must not use our Site or services.

3. Changes to Terms

Modern Yardz reserves the right to modify these Terms at any time. We will post the revised Terms on the Site, and they will become effective immediately upon posting. The “Effective Date” at the top of this page will reflect the most recent revision. Your continued use of our Site or services after any change constitutes acceptance of the updated Terms.

4. Service Use

You agree to use Modern Yardz’s Site and services for lawful purposes only and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site or our services. Prohibited activities include attempting to gain unauthorized access to our systems, submitting false or misleading information, using automated tools to scrape Site content, and transmitting harmful code or material through any form or communication channel provided by Modern Yardz.

5. User Responsibilities

You are responsible for ensuring that the information you provide to us — including contact details, project scope, property information, and any answers you provide during our consultation or design process — is accurate and complete. Inaccurate information may affect our ability to prepare an accurate design concept, budget, or project timeline. You are also responsible for maintaining the confidentiality of any account, form, or portal credentials associated with your project.

6. Payment

Payment for design, construction, and installation services must be made in accordance with the written agreement, contract, or change order executed between you and Modern Yardz for your specific project. All pricing, deposit schedules, and milestone payments are set forth in your project contract. Late payments may incur additional charges, suspension of work, or remedies available under California Business & Professions Code and applicable mechanic’s-lien law. The Site itself does not process payments; any fee quotes shown on the Site are informational only and do not constitute a binding offer.

7. Cancellations and Refunds

California home-improvement contracts include a three-day right to cancel pursuant to California Business & Professions Code §7159. Beyond that statutory window, cancellation and refund terms are governed by your individual project contract, which outlines any deposits paid, work already performed, materials already ordered, and any applicable restocking or cancellation fees. Consultation requests submitted through the Site can be canceled at any time before a design agreement is signed by replying to our email confirmation or calling us at 619-775-9554.

8. Limitation of Liability

To the fullest extent permitted by law, Modern Yardz is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, resulting from your use of, or inability to use, the Site or any information contained on it. Nothing in this section limits your rights under a fully executed construction contract or any liability that cannot be limited or excluded under California law, including the warranty obligations of a licensed contractor.

9. Intellectual Property

All content on the Modern Yardz website — including text, graphics, logos, photography, video, design renderings, process diagrams, and proprietary methodology — is the property of Modern Yardz, Inc. or used with permission of the copyright holder. Content may not be copied, reproduced, reposted, republished, or used for commercial purposes without our prior written consent. Photography of completed projects remains the property of Modern Yardz even where the homeowner’s property is featured.

10. Privacy

Our Privacy Policy describes how we collect, use, and protect information you provide through the Site, our forms, and SMS communications. By using the Site or engaging our services, you also agree to the terms of our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
